Sober Living Home: A residential dwelling operated pursuant to a program designed to provide a stable environment of clean and sober living conditions for individuals recovering from alcohol and/or drug addiction who do not require 24-hour supervision or therapeutic services on the premises. This includes facilities licensed as residential support programs and those requiring no State license, but excludes facilities licenesed as a "Residential Treatment Program" by the State of Utah.
Voluntary Abstinence: A continuous period of at least 30 days of sobriety immediately prior to occupancy. Importantly, abstinence due to incarceration is legally defined as involuntary and does not satisfy the requirements of Section 22-6-9(D)(4)(c).
Direct Threat Assessment: An individualized written assessment performed by a licensed medical professional (MD, LCSW, LPC, etc.) to determine if a resident's tenancy would constitute a threat to the health or safety of others or result in substantial physical damage to property. (Sec. 3)
Controlled Substances: Anything defined as a controlled substance under Utah Code 58-37-101, as amended.
Permit: In the City of Orem, the issuance of a Business License to operate a sober living home constitutes the required permit under Section 22-6-9(D).
